Preamble:
The App is based on remote communication between the Consultant and the Beneficiary requesting the service. Its aim is to help entrepreneurs and SME owners develop and grow their businesses, establish new businesses, reduce losses, and avoid exiting the market. These terms and conditions apply to the provision of consultations by Consultants and do not in any way constitute an employment contract between the Consultant and Monsha’at.
The Consultant shall comply with the following:
1. Represent Monsha’at appropriately when conducting consultation sessions, providing consultations to the Beneficiary, and the like; observe the laws and regulations in force in the Kingdom; adhere to public decency and good conduct when dealing with Beneficiaries and the Work Team; and refrain from exploiting the App to obtain personal benefits and gains or to market their own business outside the scope of the App without written permission from Monsha’at.
2. Understand the consultation app project and all the services Monsha’at provides, as set out in the guide provided to the Consultant, before providing any consultation through the App.
3. Exercise due care and deliver the highest standards of consulting performance and professional ethics; refrain from providing any consultation without verifying its scientific and professional soundness; and refrain from providing consultation in areas outside the Consultant’s specialization or expertise, in accordance with the evaluation criteria of the consultation session.
4. Protect and respect the intellectual property rights of Beneficiaries and Monsha’at, including, but not limited to, refraining from using the name, ideas, logo, visual materials, or documentation owned by Monsha’at or Beneficiaries without written permission from the owner.
5. Maintain the confidentiality of information and data relating to Monsha’at and Beneficiaries, or their businesses, operations, or clients, obtained as a result of providing consultations, information, advice, or solutions. The Consultant shall also not disclose such data or information to any other party without prior written consent from Monsha’at or the Beneficiaries, unless the information has already been made public.
6. Prepare the schedule of consultation sessions and update it monthly in coordination with Monsha’at for approval.
7. Provide consultation sessions during the App’s official working hours, from nine in the morning until ten in the evening, every day of the week, and attend consultation sessions at their scheduled times in accordance with the schedule agreed with Monsha’at. If the Consultant wishes to cancel a consultation session, the project manager must be notified in sufficient time (no less than 24 hours in advance), and cancellations must not exceed 5% of the monthly hours, so that a replacement consultant can be arranged.
8. In the event of repeated cancellations with less than 24 hours’ notice or failure to attend a session, Monsha’at has the right to suspend the Consultant for a period of three months.
9. The Consultant may reschedule available hours that were not delivered once a month, up to no more than 30% of the available hours not delivered.
10. Provide the Work Team with all required documents, records, and reports, including consultation session reports, periodic reports, and recommendations.
11. Refer the Beneficiary to a consultant in another field according to the Beneficiary’s needs, to achieve the greatest possible benefit for them.
12. Not share their username and password or any other means of accessing the App without written permission from Monsha’at.
13. Not misuse the App technically in any way that could directly or indirectly harm its integrity, including, but not limited to, attempting to compromise the data of the App or its users by copying, deleting, destroying, or unlawfully accessing it.
The Consultant acknowledges Monsha’at’s right to direct the operating company to remove the Consultant in the following cases:
- If the results of Beneficiaries’ satisfaction ratings of the consultation sessions fall below 80%.
- If complaints on the same matter are repeated by more than one Beneficiary.
- If the documents or information on which the Consultant’s provision of consultations was based prove to be inaccurate, such as if the Consultant’s academic certificates prove to be unaccredited, or the practical and professional experience proves to be inaccurate.
- In the event of a breach of any of the terms agreed in this document.
- If consultation sessions are not delivered in accordance with the agreed schedule without an acceptable excuse.
General Provisions:
- In the event of any technical problems, you can contact us by email at info@monshaat.gov.sa.
- The Consultant acknowledges and understands that the consultations, information, advice, recommendations, proposals, and the like that they provide represent them personally; that they may not provide any of them in the name of Monsha’at, any of its staff, or the Work Team under any circumstances; and that they have no right to bring claims, complaints, lawsuits, or the like against Monsha’at based on their use of the App and/or their provision of consultations.
